1. If possible, move your car or motorcycle out of traffic and turn on its flashers.Put out warning triangles or flares, if you have them. Then stand a safe distance away while you talk to other drivers or wait for help.
2. Double-check yourself and your passengers to make sure no one is hurt. Even a fender bender might have caused an injury that’s not noticeable right away.Summon medical help if there is any doubt.
3. Call the police. Ask for the investigating officer’s name and contact information, and for the accident report number so that you can follow up.
4. Obtain the name, address, telephone number, driver’s license number, plate number and insurance information of any other drivers in the accident, along with the names of anyone with injuries and any witnesses.
5. Do not argue over who is at fault or admit blame.
6. Take photographs and video of the scene of the auto accident, the damage to the vehicles and people on the scene (a cell-phone camera will do). If you do not have a camera, ask the police officer to take photographs and draw a diagram showing the car’s positions.
7. If you did not immediately seek treatment at a hospital by ambulance, seek medical attention as soon as possible and describe to your doctor the specifics of the accident, and your injuries.
8. Do not sign any documents selling or disposing of your vehicle before speaking with an attorney. Your vehicle may need to be inspected by an accident reconstruction expert.
9. Document all medical appointments and keep all bills, prescription records, letters from insurance companies, etc.
10. Seek the advice of an attorney experienced in auto accident litigation, before speaking with an insurance company representative, who will likely call you within hours after you report the accident.
